I engaged Green Earth Landscaping to design a storm water abatement project with the clearly stated proviso that it be approved by Arlington County's StormwaterWise Program, which was subsidizing the project. I have been trying to recover the significant deposit that I paid out to initiate the design, which was ultimately rejected by the County. And creation of the design took so long that I was up against the County's deadline for installation. During the delay, I had asked that another designer be assigned to my project, but the company declined to do this. In order to meet the County's deadline, I had to design and install the plan myself. Considering that Green Earth did not fulfill the contract obligations, I asked for the return of my deposit. On Nov. 5, 2014, I received an e-mail from the owner promising to send the check to me within 10 days. I am still waiting. I have tried to contact him by phone and e-mail, and he will not respond at all.
