Terhune publishes a Homeowner s Orientation Manual which contains a change form with spaces for description of the change, the cost and signatures of the parties. We received this manual over EIGHT MONTHS after signing our contract, at our walk-through, which supposedly occurs upon substantial completion.
We needed several changes, but Terhune did not present us with ANY of these forms. He got away with implementing and billing us for changes which we had not properly reviewed and approved.
Terhune left us unsatisfactory work on our fireplace, excavation and bathroom tile work. He allowed misalignment of lights over countertops in the kitchen and bathroom and refused to give us an as-built electrical plan to use for future reference.
Terhune failed to coordinate plans for work of its subcontractors and suppliers. This is an obvious error in management and defect in workmanship. We contend that rework is appropriately his responsibility.
